1. Agreement to Terms

These Terms of Service (hereinafter "these Terms") govern the agreement between Akira Kawata (hereinafter "Provider"), the provider of MiRAGE (hereinafter "the Application"), and users of the Application (hereinafter "User"). By downloading, installing, or using the Application, User agrees to be bound by all provisions of these Terms. If User does not agree to these Terms, User must not use the Application.

1.1 Age Restriction

The Application is intended for users aged 13 and above. Users under 13 years of age are not permitted to use the Application.

2. Changes to Terms

Provider may modify or update these Terms at any time without prior notice to User. Updated Terms become effective upon posting on the Application or website. Continued use of the Application after changes constitutes acceptance of updated Terms. Provider will provide separate notice within the Application for significant changes.

3. License to Use

Provider grants User a non-exclusive, non-transferable license to use the Application. User may use the Application for personal use purposes in accordance with these Terms. User may not perform the following actions:

  • Reverse engineer, disassemble, or decompile the Application
  • Copy, modify, alter, or create derivative works of the Application
  • Lend, resell, distribute, or transmit the Application to third parties
  • Use the Application for simultaneous multi-device use (concurrent use on multiple devices)
  • Remove or alter copyright notices in the Application
  • Publish or distribute software derived from the Application

4. User Responsibilities

User assumes the following obligations when using the Application:

  • Provide truthful and accurate information
  • Strictly manage own password and account information, and not disclose to third parties
  • Take responsibility for all activities performed using own account
  • Comply with all applicable laws and regulations related to use of the Application
  • Report any bugs, errors, or security vulnerabilities in the Application to Provider

5. Prohibited Activities

User is prohibited from performing the following activities while using the Application:

  • Actions that violate laws, regulations, or these Terms
  • Actions that infringe upon rights of third parties or Provider (intellectual property rights, defamation rights, privacy rights, etc.)
  • Defamation, threats, harassment, or bullying of other users or Provider
  • Providing false information or impersonating others
  • Spam, fraud, deceptive practices, or illicit activities
  • Distributing or uploading malware, viruses, or harmful code
  • Interfering with or disrupting normal operation of the Application
  • Using the Application for commercial purposes without Provider's prior written consent
  • Providing inappropriate content to minors

If User engages in any of the above prohibited activities, Provider may suspend or delete User's account without prior notice.

6. Future Features: Advertising and Billing

6.1 Advertising Delivery

Provider may distribute advertisements through AdMob in the future. Advertisements may be provided through third-party ad networks, and the privacy policies of ad networks will apply. Provider is not responsible for the content of advertisements.

6.2 Billing Features

Provider may provide billing features within the Application in the future. If billing features are implemented, Provider will notify User of the following matters separately:

  • Fees and payment methods
  • Automatic renewal and cancellation methods
  • Refund policy

For charges made through Apple In-App Purchase (IAP), Apple's terms will take precedence. Details of billing features will be announced by updating these Terms upon implementation.

7. Intellectual Property

The Application, its content, features, designs, and all rights belong to Provider or its licensors. All content provided through the Application is protected by copyright law and international treaties.

User retains ownership of photos or images generated or saved through the Application. However, User agrees to use content generated through the Application only for personal use purposes and not for commercial purposes. Do not generate or use content that may infringe upon the rights of third parties.

8. Data and Privacy

Provider respects User's privacy. For data collected in connection with use of the Application, please refer to the Privacy Policy. By using the Application, User is deemed to have agreed to the Privacy Policy.

Provider will not collect, use, or share User's personal data beyond the purposes described in the Privacy Policy.

9. Disclaimer of Warranties

The Application is provided "AS IS" and "AS AVAILABLE". Provider makes no warranties, express or implied, including but not limited to the following:

  • That the Application will meet User's requirements or expectations
  • That the Application will operate without interruption or error-free
  • The accuracy, reliability, or completeness of Application's features or content
  • The accuracy of information or content provided through the Application
  • That bugs or errors will be corrected
  • That the Application is free of viruses or harmful components

Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to User.

10. Limitation of Liability

To the maximum extent permitted by applicable law (including Consumer Contract Act), Provider shall not be liable for any direct, indirect, incidental, special, or consequential damages (including but not limited to loss of profits, loss of data, or business interruption) arising from or related to use or inability to use the Application.

If Provider is liable for damages, except in cases where Provider or its agents have acted with intent or gross negligence, the maximum liability of Provider for the Service shall be limited to the total amount of fees paid by User to the Service in the past three months (minimum 1,000 JPY if such amount is less than 1,000 JPY).

The above limitation of liability does not apply to damages arising from intent or gross negligence of Provider or its agents, or damages arising from personal injury or death.

11. Termination

User may delete own account and stop using the Application at any time. Account deletion can be performed by uninstalling the Application from the device.

Provider reserves the right to suspend or delete User's account without prior notice in the following cases:

  • User violates these Terms
  • User engages in prohibited activities
  • Laws or regulations are violated
  • Provider determines that it is difficult to continue providing the Service
  • User's account remains unused for an extended period (12 months or more)

Provider reserves the right to temporarily suspend or terminate all or part of the Service without prior notice. In case of termination, Provider will provide prior notice.

12. Governing Law and Jurisdiction

All disputes related to these Terms and the Service shall be governed by the laws of Japan (excluding application of foreign laws under the Act on General Rules for Application of Laws).

All disputes related to the Service shall be exclusively subject to the jurisdiction of the Chiba District Court or Tokyo District Court as the court of first instance.

13. Severability

If any provision of these Terms is determined to be invalid or unenforceable by a court of competent jurisdiction or arbitrator, the remaining provisions shall remain in full force and effect. Invalid or unenforceable provisions shall be modified to the extent necessary to make them valid and enforceable.

14. Platform Disclaimer

The Application may be provided through Apple App Store. Apple Inc. is not the provider of the Application and is not a party to these Terms. Apple makes no warranties about the Application or its content. Apple assumes no responsibility for any issues related to use of the Application.
